The process of selling a house is often a stressful and confusing experience. For a number of reasons you should retain an attorney to represent you. One of the most important reasons: The sale of your house is a publicly-sanctioned transaction. That means it is governed by federal and state laws as well as local procedures within the municipality in which the house is located. If you are not well versed in the relevant law and procedures, you can expect problems down the road.
A real estate transaction involves the drafting and executing of numerous documents. One of the most important of these documents is the “Contract for Sale” of the house. Although there are several common “forms” of real estate contracts, you might not understand what you are reading. As a result, you might not know it when something is amiss with the contract—unless you have retained an attorney to represent you.
Another good reason to retain an attorney is that the sale of your house involves a multitude of “players.” These include lending representatives, real estate agents, inspectors, buyers, sellers, local officials, and title company representatives. You will need someone to represent you who knows how to communicate with each of these players.
